The short answer is yes, CBD from both marijuana and hemp is legal in Philadelphia according to Pennsylvania state law.

In April of 2016, the state of Pennsylvania legalized medical marijuana. This allowed patients with qualifying medical conditions to buy, use, and possess marijuana for medical use.

Qualified patients with valid medical cards are allowed to possess up to a 30-day supply of marijuana products, including marijuana-derived CBD products with high THC content.

That same year, the state also launched its Industrial Hemp Research Pilot Program, allowing the cultivation and research on industrial hemp.

The passage of House Bill 967 in 2016 also legalized the cultivation and processing of industrial hemp with less than 0.3% THC. This bill had set the standard THC limit of 0.3% on industrial hemp.

HB 967 gave residents of Pennsylvania, including Philadelphians, the right to buy, use, and possess hemp-derived CBD products containing no more than 0.3% THC.

The passage of the 2018 Farm Bill further legalized industrial hemp. Not only did this federal law legalize industrial hemp (including all its parts, cannabinoids, extracts, isomers, etc.) containing 0.3% THC — it also made hemp-derived products accessible to all Americans.

No possession limits or age restrictions were imposed on the use of hemp-derived CBD products, as long the THC content doesn’t exceed 0.3%.

Of note, hemp containing more than 0.3% THC is considered marijuana and is, therefore, federally illegal.
